General provisions
The website of CAMERA REVIVAL, with registered office at Nieuwstraat 31, 3511 Kuringen, Belgium, registered under the company C.R. Optics bv and tax number BTW BE 1012 027 328 offers its customers the opportunity to send in product for repairs or to purchase products from the webshop.
These General Terms and Conditions (“Terms”) apply to any order placed by a visitor of the website (“Customer”). Placing an order via the CAMERA REVIVAL webshop implies that the Customer has consulted these Conditions and expressly accepts the applicability of these Conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted in advance, in writing by CAMERA REVIVAL.
Price
All prices stated are expressed in EURO, including VAT (unless stated otherwise). If the customer is situated outside of the European Union, additional import taxes and duties might apply. These additional charges are not mentioned on the website. It is the Customer’s sole responsibility to pay for these additional import taxes and duties. Please contact your local customs office for more information.
In the unfortunate event of an international order being returned to us, we cannot refund customs charges, or import duties/taxes. Please take this into consideration when ordering a product.
If any additional delivery, reservation or administrative costs are charged, this will be stated separately.
The price mentioned refers exclusively to the goods as described. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.
Offer
Despite the fact that the website and the e-commerce part of the website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains errors, or is not up-to-date. Obvious mistakes or errors are not binding and don’t prevent CAMERA REVIVAL from cancelling an order.
If the Customer has specific questions about, for example: sizes, colours, availability, delivery time or delivery method, … we request that the Customer contacts us in advance.
Any offer mentioned on the website is valid while the stocks last and can be adjusted or withdrawn at any time by CAMERA REVIVAL. CAMERA REVIVAL cannot be held liable for the unavailability of a product. In case of unavailability of a product, CAMERA REVIVAL will inform the Customer by e-mail as soon as possible. The latter will have the possibility to choose between waiting (in case of temporary unavailability) or cancelling the order at no charge.
Online purchases
The buyer, who wishes to purchase a product or service, must obligatorily:

- Fill in the registration form;
- Select the products to be ordered;
- Validate his order;
- Acknowledge having read and accepted the present general conditions;
- Carry out the payment;
- Confirm the order and payment.
The sale is deemed completed when the seller confirms the order and the payment has been received.
No shipment of goods will be made without the completion of these steps.
The Customer has the choice between the following payment methods:

CAMERA REVIVAL is entitled to refuse any order (in writing) due to a serious shortcoming of the Customer with regard to the order or any other order or agreement in which the Customer is involved.
Delivery and execution of the agreement
Items ordered through this web store are delivered in to most countries, unless stated otherwise.
Delivery is made by a variety of different shippers, depending on the goods that needs to be delivered and the country where the goods need to be delivered to.
Unless otherwise agreed, the goods will be delivered to the Customer’s place of residence within 30 days of receipt of the order.
Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately by the Customer to CAMERA REVIVAL, as well as to the shipper upon acceptance of the goods.
The Customer bears the risk of loss or damage (or a third party designated by him, who is not the carrier) once he has physically acquired the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by CAMERA REVIVAL. Goods are never shipped uninsured or without tracking information, even if the Customer requests to do so.
Once the goods have been dispatched, we cannot be held responsible for any delays caused by the shipper. Goods are always shipped with delivery confirmation.
Repairs
All estimated dates given by CAMERA REVIVAL for the completion of repairs are estimates and should be interpreted as such. CAMERA REVIVAL shall not be held liable for any loss/compensation resulting from failure to meet such dates. Failure to meet such dates shall not entitle the Customer to cancel the order.
CAMERA REVIVAL is responsible for Customer’s goods until the Goods are delivered back to the Customer. All goods are insured at the second hand value of the goods.
CAMERA REVIVAL shall not be held responsible for any accessories left by the Customer accompanying the Goods.
If the Customer fails to pay for the repair after a 1-month period has passed from the moment that he has been informed of the repair costs, CAMERA REVIVAL reserves the right to sell the repaired goods in order to recover the costs of those repairs and any additional loss caused by this delay. All bills/invoices are payable within 7 days. In case of full or partial non-payment of the bill/invoice on the due date, a reminder bill/invoice will be sent and the total outstanding amount shall be increased by 10% interest per annum and will include a damage clause of 10% with a minimum of 40 euros. Any other outstanding invoices shall become due immediately.
Retention of title
The delivered items remain the exclusive property of CAMERA REVIVAL until full payment has been made by the Customer.
Right of withdrawal
The provisions of this article only apply to Customers who, in their capacity as consumers, purchase items online from CAMERA REVIVAL.
If the right of withdrawal applies:
The Customer has the right to withdraw from the agreement within a period of 14 calendar days after receiving the goods.
To exercise the right of withdrawal, the Customer must inform CAMERA REVIVAL by means of an unambiguous statement (e.g. in writing by post or e-mail) of its decision to withdraw from the contract.
In order to comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to CAMERA REVIVAL without delay, no later than 14 calendar days after the day on which he communicated his decision to withdraw from the contract to CAMERA REVIVAL, Nieuwstraat 31, 3511 Kuringen, Belgium.
The direct costs of returning the goods shall be borne by the Customer.
If the returned goods are in any way diminished in value, CAMERA REVIVAL reserves the right to hold the Customer liable and claim compensation for any loss in value of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Only goods that are in their original packaging, together with all accessories, manuals and invoice or proof of purchase can be returned.
CAMERA REVIVAL doesn’t provide partial refunds.
CAMERA REVIVAL reimburses the Customer with the same payment method with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.
The Customer cannot exercise the right of withdrawal for:

- service contracts after the full performance of the service [if the performance has started with the express prior consent of the Customer, and provided that the Customer has acknowledged that he will lose his right of withdrawal once the contract has been fully performed];
- the delivery of goods manufactured according to the Customer’s specifications;
- the delivery of goods that spoil quickly or that have a limited shelf life;
- agreements where the Client has specifically requested CAMERA REVIVAL to visit him to carry out urgent repairs or maintenance;
- sale items or items sold as for parts or repairs.

Warranty
According to the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has certain legal rights. This legal warranty applies from the date of purchase by the Customer.
To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.
In any case, any defect must be reported by the Customer immediately after its discovery. Failure to do so, results in a loss of any right to repair or replacement. If the Customer continues to use the goods once the defect has been discovered, this action results in the loss of warranty.
The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, fall damage, water damage or any other environmental damage, use of goods other than the intended purpose for which they were designed, non-compliance with the instructions or manual, adjustments or changes to the goods, abuse, poor maintenance, or any other abnormal or incorrect use. This also includes the use of goods in harsh conditions. Any repairs or alterations to the goods by any other party than CAMERA REVIVAL lead to an immediate termination of the warranty.
All good sold on this website are provided with a 12-month warranty. Defects that manifest themselves after a period of 6 months following the date of purchase, are deemed not to be hidden defects, unless proven otherwise by the Customer.
The warranty is not transferable.
Liability
CAMERA REVIVAL cannot be held liable in any way for acts, failures, omissions or delays resulting in issues such as (but not limited to) loss of sales, business, profits, reputation, business interruption or any other losses.
CAMERA REVIVAL shall be relieved from any liability for failure to comply with any obligation imposed on him by this agreement for the duration and scope of such failure, if such failure is caused by events that escape his reasonable control, including but not limited to natural disasters, rebellion, terrorism, war and military operations, acts or omissions of the government, strike and lockout, fire and water damage, epidemics and pandemics.
Infringement of validity
If any provision of these Terms and Conditions is held to be invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by CAMERA REVIVAL to enforce any of the rights set forth in these Terms and Conditions, or to exercise any right hereof, shall never be deemed a waiver of such provision and shall never void the validity of these rights.
Changes to the Terms & Conditions
CAMERA REVIVAL reserves the right to alter these Terms and Conditions without prior notice. By visit the website, the Customer agrees to these altered Terms and Conditions.
Evidence
The Customer accepts that electronic communications and backups can serve as evidence.
Applicable law – Competent court
The Belgian law is applicable to this website. In the event of a dispute only the courts of the district of Hasselt are qualified.
